International flavor and fragrance giant DSM-Firmenich (Dsm-Firmenich) has reached a settlement with direct purchasers in a joint antitrust class action lawsuit, with the settlement amounting to $33 million. The settlement agreement was preliminarily approved by the United States District Court for the District of New Jersey on August 4. This class action lawsuit originated in August 2023, involving multiple class actions filed against four global large-scale flavor and fragrance companies by various plaintiffs, including ordinary consumers, direct purchasers, and indirect purchasers. The defendants are DSM-Firmenich, Swiss Givaudan (Givaudan), American IFF (International Flavors & Fragrances), and German Symrise (Symrise). The plaintiffs allege that from January 2018 to April 2023, the four companies were suspected of colluding to manipulate the prices of flavor raw materials, conspiring to divide the production of natural and synthetic flavor raw materials used in cosmetics, detergents, and perfumes. The plaintiffs also pointed out that the market concentration of the flavor industry is high, "more susceptible to collusion and other anticompetitive behaviors..."
